PwC by Your Side 24/7: New Amendments to Law no. 489/1999

Important amendments have been made to Law no. 489/1999 on the public social security system, including:

• Information for establishing social security rights under the public social security system (DSA19 Form) has to be presented by employers (in paper form or using the automated electronic reporting method, with electronic signature) on the date they issue an order on child-care leave, paternity leave or dismissal.
• Law no. 489/1999 is to include provisions on categories of payers and insured people, social security contribution (SSC) rates, the SSC taxable base, payment deadlines, SSC exempt income and social security benefits.
• The SSC fixed annual amount will be approved through the Law on the state social security budget.
• Material aid granted to current and former employees is no longer exempt from employer and employee SSC.

The amendments enter into force on 1 January 2019.

Va informam ca au fost aduse amendamente la Legea nr. 489/1999 privind sistemul public de asigurari sociale. Principalele modificari sunt:

• Informatia privind stabilirea drepturilor sociale in sistemul public de asigurari sociale (Forma DSA19) va fi prezentata de angajatori (pe suport de hartie sau utilizand metode automatizate de raportare electronica cu aplicarea semnaturii digitale) la data emiterii ordinului de acordare a concediului de ingrijire a copilului, a ordinului de acordare a concediului paternal sau a ordinului de eliberare din campul muncii, dupa caz.
• Categoriile de platitori si de asigurati, cotele de contributii de asigurari sociale (CAS), baza de calcul si termenele de achitare a CAS, veniturile neimpozabile cu CAS si tipurile prestatiilor sociale asigurate vor fi incluse in Legea 489/1999.
• CAS stabilite in suma fixa anuala se vor aproba prin Legea bugetului asigurarilor sociale de stat.
• Ajutorul material acordat angajatilor sau fostilor angajati nu va mai fi o sursa de venit neimpozabila cu CAS atat la nivelul angajatului, cat si al angajatorului.

Aceste modificari vor intra in vigoare la data de 1 ianuarie 2019.
