This Legal Flash No 4 brings you the latest news on amendments in the Law on compulsory third party liability motor vehicle insurance. The law has set, among others, new limits of insurer’s liability and rules of establishing the costs of repair.

Insurance agreement between the owner of the vehicle and the insurer licensed for compulsory liability motor insurance could be perfected through electronic technical means in on-line regime according to the procedure established by normative acts of the supervisory authority. For the application of the bonus-malus system the insurers will have access to information on the history of insured damages and of vehicle owner from the unified information system organized by the supervisory authority.

The law modified the limits of insurer’s liability. Thus, for damages or loss of property independent on the number of people suffered due to the road accident, the maximum liability of the insurer is MDL 1.000.000. Similarly, for bodily injury or death of each victim the liability limit is MDL 1.000.000, but not more than MDL 5.000.000, irrespective of the number of people injured by the road accident. 

In case of accident, the insured person is obliged to submit to the office of the insurer personally or through his legal representative, the act of competent authorities and institutions in respect of the road accident, a valid driving license for the due category, vehicle registration certificate and the periodical technical inspection report for the vehicle that caused the accident. The insured person shall also ensure, upon request of the insurer, access to the vehicle, which caused the accident.
