Technical Regulation on Toys Safety sets conditions on toy safety. The Regulation applies to products conceived or intended exclusively or non-exclusively, for use in play by children under the age of 14 years.
Among the basic regulations the following can be highlighted:
- Upon placing toys on the market manufacturers shall ensure that these have been designed and manufactured in accordance with essential requirements of safety.
- Toys, including chemical substances contained in such toys, should not endanger the safety or health of users or third parties.
- Upon placing toys on the market, manufacturers shall make the required technical documentation, based on which a declaration of conformity shall be executed and CE marking of conformity shall be applied.
- Application on the products of the markings, signs or inscriptions that may mislead third parties as to meaning and / or form of the conformity marking is prohibited.
- Technical documentation and declaration of conformity should be kept for 10 years after the toy was placed on the market.
- Manufacturers who consider or have reason to believe that a toy which they have placed on the market does not comply with the requirements of the legislation shall take immediate and required corrective measures in order to restore compliance of the said toy or to withdraw or recall the toy from the market. If the toy presents a risk, manufacturers shall inform immediately the Consumer Protection Agency.
- Before placing a toy on the market, manufacturers shall carry out an analysis of the chemical, physical, mechanical, electrical, flammability, hygiene and radioactivity dangers that the toy may present and an assessment of the potential exposure to such risks.
- Prior to placing a toy on the market, the importer shall ensure that corresponding procedure of the conformity assessment has been fulfilled by the manufacturer.
- Importers shall ensure that the toy is accompanied by instructions translated into the national language in order to be understood by the consumers.
