This Legal Flash brings you latest news on amendments of the Patent Law and adoption of the new Regulation by the National bank of Moldova on opening of the bank accounts by Moldovan residents in foreign countries.

Law on protection of inventions (Law No 50 dated 7 March 2008) has been recently amended. Among the basic amendments the following could be highlighted:
• Recognition and protection on the territory of Moldova of the rights deriving from a validated European patent (patent issued by the European Patent Office under European Patent Convention, adopted at Munich on 5 October 1973, based on European patent application, which was requested for validation in Moldova). The State Agency on Intellectual Property (Agency) will have the competence to validate the effects of European patents on the territory of the Republic of Moldova.
• European Patent Application and validated European Patent will have the same effect and will be subject to the same conditions as the national patent application or patent.
• A European patent application for which a validation fee has been paid will be transformed into a national patent application by submitting to the Agency a request for transformation.
• European Patent Application and European Patent issued on the basis of such an application will be validated in the Republic of Moldova if the applicant requests such validation in the European patent application.
• Each request for validation will be published by the Agency and will be included in the National Register of patent applications after informing the European Patent Office on payment of the prescribed fee for validation. The request for validation may be withdrawn at any time.
• Validation fee shall be paid at the European Patent Office within 6 months from the date when publication of the European documentary examination report is mentioned in the European Patent Bulletin. The validation fee may not be refunded.
Annual fees shall be paid for maintenance of the effect of the validated European patent.
