Call for Expert / Legal Consultant Strengthening Moldova’s Investment Screening Framework

AmCham Moldova is seeking to contract a legal expert / consultant to provide technical assistance within a project aimed at strengthening Moldova’s investment screening framework, while preserving an open, transparent, and attractive investment climate.

The assignment will focus on the review and improvement of the legal and procedural framework applicable to the screening of investments in sectors relevant to state security, covering Law No. 174/2021 on the mechanism for examining investments of importance for state security, related secondary legislation, and the procedures applied by the Secretariat of the Council for the Examination of Investments of Importance to State Security.

Scope of Work

The expert / consultant will be expected to carry out the following main activities:

1.Review of the regulatory framework

The expert will assess the practical functioning of Law No. 174/2021 and related secondary legislation, with a view to identifying legal gaps, ambiguities, procedural bottlenecks, and implementation challenges faced by investors, the business community and, where relevant, public authorities.

Based on this assessment, the expert will formulate proposals for improving the legal and regulatory framework, including possible legislative amendments, procedural clarifications, and practical solutions aimed at enhancing legal certainty, predictability, and proportionality in the investment screening process.

 

2. Review and improvement of institutional procedures

The expert will assess the procedures applied in the examination of investment projects of importance for state security and will propose practical improvements aimed at enhancing administrative efficiency, consistency, and predictability of the review process.

This may include the development or improvement of practical tools such as risk-screening checklists, indicative decision-making frameworks, procedural templates, and other instruments designed to support the examination of investment projects of importance to state security.

Expected Deliverables

The expert / consultant will be expected to deliver, at minimum:

  • an assessment of the existing legal and procedural framework;
  • a set of recommendations for improving Law No. 174/2021 and related secondary legislation;
  • proposals for improving the procedures applied in the examination of investment projects by the Secretariat of the Council for the Examination of Investments of Importance to State Security;
  • practical tools for investment screening, including risk-screening checklists, review workflows and/or indicative decision frameworks;
  • a final position paper / report summarizing the findings, conclusions, and proposed improvements.

 

Required Profile

The ideal candidate should have:

  • a university degree in law, public policy, economics, international relations, or another relevant field;
  • demonstrated experience in legal and regulatory analysis;
  • strong understanding of investment policy, regulatory procedures, public-private dialogue, and administrative decision-making processes;
  • excellent drafting and analytical skills;
  • ability to formulate practical, clear, and implementable recommendations.

 

Experience in one or more of the following areas will be considered a strong advantage:
 

  • foreign direct investment screening;
  • investment regulation;
  • national security-related review of investments;
  • strategic sectors, critical infrastructure, energy, ICT, or dual-use goods;
  • work with public authorities, investment councils, business associations, or international development projects.
