Policy Win: The Parliament of the Republic of Moldova Amended the State Fee Law (Regarding the Amount of the State Fee for Requests of Recognition, Enforcement, and Annulment of Arbitral Awards)

AmCham Moldova continues to support improvements to the legislative framework and successfully brought to the authorities’ attention a legislative gap in the State Fee Law: the absence of a specific fee amount for requests related to the recognition, enforcement, and annulment of arbitral awards.

This omission led to divergent interpretations in the courts, resulting in:

  • the application of inconsistent fees—some fixed, others proportional to the value of the claim—leading to excessive costs for litigants;

  • a lack of predictability for the business environment and difficulties in accessing justice.

As a result of AmCham’s request, the Ministry of Justice proposed in a draft law the establishment of a fixed fee of 250 MDL for such requests, and the Parliament of the Republic of Moldova adopted the draft law in the final reading on May 22, 2025.
