AmCham Moldova a elaborat o scrisoare de poziție asupra proiectului de lege pentru modificarea unor acte legislative și reglementarea regimului clauzei de schimbare a controlului investițiilor.

În scrisoarea de poziție au fost indicate o serie de riscuri care pot fi generate prin adoptarea proiectului de lege, autorităților publice fiindu-le comunicat faptul că instituirea oricărui mecanism suplimentar de control/verificare a investițiilor trebuie analizat sub toate aspectele, în special cel al protejării investițiilor și creării unui climat investițional favorabil, al legalității și predictibilității, precum și al obligației pozitive a statului de a asigura garantarea dreptului de proprietate și libertatea activității de întreprinzător (art. 46 și 126 din Constituție), precum și respectarea tratatelor internaționale (inclusiv a tratatelor bilaterale privind protecția investițiilor).

AmCham Moldova has elaborated a position paper on the draft law amending certain legislative acts and regulating the regime of the investment change of control clause.

The business community lists a number of risks that may arise as a result of the adoption of the draft law, informing public authorities that the establishment of any additional control/verification mechanism must be assessed from all the perspectives, in particular from the point of view of protecting investments and building a favorable investment climate, legality, and predictability, as well as the positive obligation of the state to safeguard the right to ownership and the freedom of entrepreneurial activity (art. 46 and 126 of the Constitution), as well as the compliance with the international treaties (including bilateral treaties on the investment protection).
