This Legal Flash brings you the latest news on amendments in the Law on electronic commerce setting new requirements for information of consumers.

The Law on general safety of products was amended to introduce the rapid information exchange systems on dangerous products.

Law on electronic commerce was supplemented by a new provision regarding the content of the information which individual or legal entity performing electronic commerce shall make available to other subjects of commerce and control bodies. This information shall include the rights of consumers as well as the contact phone number and the official website of the Agency for Consumer Protection.

Article 344 of the Code of administrative offences was completed with paragraphs (7)-(9). Amendments are referring to sanctioning the acts of infringement of information requirements for contracts negotiated away from business premises and distance contracts, as well as for contracts other than those negotiated. For example, infringement of information requirements for contracts negotiated away from business premises and distance contracts through:
- failure to submit or incomplete submission of pre-contractual information;
- failure to inform of the main characteristics of the goods or services;
- failure to inform on the total price of the goods or services inclusive of taxes, additional transport and shipment costs, postal any other type of taxes, failure to indicate that such additional charges may be payable by the consumer; shall be deemed administrative offences.

Similarly, failure by the merchant to reimburse the amounts received as payment from theconsumer or reimbursement thereof after 14 days from the date of the notification of the decision to revoke the contract, shall be subject to administrative liability.
