New legislation of the Republic of Moldova

Government Decree

On the determination of the amount of regulatory and monitoring fee for 2016. The Decree of the National Agency for regulation in the field of electronic communications and information technology No.66 of 23 October 2015
1. Regulatory and monitoring fee to providers of electronic communications networks and services for the year 2016 set at 0.3 per cent of the income received from activities in the field of electronic communications.
2. Regulatory and monitoring fees shall be paid by the providers of electronic communications networks and services to the current bank account of ANRCETI on a quarterly basis up to 15th day of the month following the reporting quarter.
The decree enters in force from 23 October 2015.

On approval of the template document informing on the video surveillance realization. The Order of the Director of the National Center for personal data protection No.581 of 10 September 2015
1. In the case of the video surveillance the appropriate standard forms of informing shall be placed.
2. This information shall be placed in the area of the video surveillance at a considerable distance from surveillance devices to ensure its visibility.
The order enters in force from 25 September 2015.

On approval the rules on the residents accounts abroad. The Decision of the Administrative Council of the National Bank of Moldova No.216 of 20 August 2015
1. The opening by a resident the bank accounts in a non-resident bank in national or foreign currency, as well as carrying out transactions via this accounts is permitted only upon receipt of the National Bank of Moldova permission for opening the bank accounts abroad.
2. The resident receiving the NBM permission is required to open the bank account abroad within 180 days from the date of issue of the permit. If, at the expiration of this period, the account has not been opened, the permission shall be void and its original shall be returned to the NBM within 5 working days from the date of the expiration of the time limit.
3. To obtain the NBM permission to open the bank accounts abroad, the following documents shall be presented:
- Application;
- Registration certificate;
- Extract from the State Register;
- Constitutive documents (with all changes and additions;
- Documents confirming the necessity of opening the bank account abroad (agreements, contracts) and other documents relevant for the application examination.
4. On the NBM demand the documents in foreign languages shall be submitted along with notarized translations into the national language.
5. The documents are submitted to the NBM in original or photocopies with submission of originals for comparation.
After the certification of photocopies by the BNM responsible person the original documents will be returned to the applicant and certified photocopies are stored in the NBM.
6. Into the bank accounts opened abroad allowed by the NBM can be credited only the following funds:
a) The amount of interest payable by the non-resident bank;
b) The funds, previously written off from the account and further fully or partially refunded.
The decree enters in force from 18 October 2015.
