PwC Moldova: Is it a Real Tax Inspection?

According to a recent press release by the Main State Tax Inspectorate (MSTI), increasing numbers of companies are becoming targets of false “tax inspections” performed by unauthorised persons. The press release can be accessed at the following link http://www.fisc.md/article.aspx?id=2049.

Given this background, we would like to draw your attention to some important matters to be considered with regard to tax inspections.

Under the current legislation, a tax inspection may be conducted by the following tax administration authorities within their competencies: tax authorities, customs authorities, local tax collection services and other competent bodies, as provided by law.

Please also note that all tax inspections have to be conducted in accordance with the tax rules and procedures established by the Tax Code.

Under existing practice, the MSTI publishes on a quarterly basis the list of large taxpayers and on a half-yearly basis the list of other taxpayers subject to total tax inspections.

As a general rule, you should be notified of a tax inspection (except in the case of operational compliance spot checks by inspectors) at least three working days before it is due to begin.

We also draw your attention to the fact that tax inspectors are entitled to initiate an inspection based on the following documents:

• Tax official’s identity card, the template for which was approved by MSTI Order no. 31, dated 2 March 2007;
• The decision on conducting the tax inspection of the target, as issued by the head of the tax authority.
